Why A Board of Zoning Appeals

When the State recognized zoning as a valid exercise of governmental power for protection of the health and safety of the public, it also recognized that zoning is applied in a broad and general way. It also recognized there would be situations where a particular property, because of a unique situation, may not be able to comply with one or more requirements of the zoning ordinance. Sometimes an especially difficult problem may make a property unsuitable for the uses allowed by the zoning code.

In order to provide a fair and equitable way of giving the owner of a property the opportunity to obtain relief in a situation where a property is burdened by a difficulty or hardship, the law required the creation of a Board of Zoning Appeals to hear and decide such issues.
