Many of the City’s neighborhoods pre-date the zoning code and most certainly pre-date the existing zoning regulations. In general, a single family home may be built in a single family zoned district on any existing lot in excess of 5,000 s.f. simply by obtaining a building permit. Lots of smaller size require an area variance by the Board of Zoning Appeals. The Board, in most instances, must grant the request provided the home constructed is compatible with homes in the surrounding vicinity. Only in a rare situation could the Board deny the use of a prior recorded lot. Having once attempted to do so, the Board’s denial of the right to build was tested in Court and overturned.
