The Hearings

The Board of Zoning Appeals is an administrative and quasi-judicial body. Its decisions carry the weight of the law and are appealable only to a court of law. Thus the Board takes its responsibility and the gravity of its decision with seriousness and solemnity. In general, the Board:

  1. Will listen to sworn testimony of the applicant and others at the meeting
  2. Examine maps, plans, drawings, photos, etc.
  3. Ascertain the facts, and
  4. Make a decision on the basis of the facts, the requirements of the Zoning Code, and the law.
  5. The Board, in most instances, makes its decision on the night of the hearing. Some items may be tabled to allow additional study
